These Terms of Service ("Terms") govern access to and use of anesthesio.com and related products, features, and services offered by Anesthesio ("Anesthesio," "we," "our," or "us"). By accessing or using the Services, you agree to these Terms.
1. Eligibility and Accounts
- You must provide accurate, current information when creating an account.
- You are responsible for safeguarding account credentials and all account activity.
- You must promptly notify us of unauthorized access or suspected account compromise.
- We may suspend or restrict access to accounts that violate these Terms or create security, legal, or operational risk.
2. Marketplace Services
Anesthesio provides a marketplace and related tools for anesthesia hiring and job discovery. We do not act as an employer, staffing agency, recruiter, career counselor, or guarantor of any candidate, employer, or recruiter.
- The display of any job listing, employer information, compensation figure, or facility detail on the Services does not constitute an offer of employment, solicitation, endorsement, certification, verification, recommendation, or guarantee by Anesthesio.
- We do not guarantee interviews, offers, placements, or hires.
- We do not guarantee that any listing is complete, accurate, or currently available.
- Recruiters and hiring entities are solely responsible for vetting candidates and making employment decisions.
3. Employer Verification and Listing Integrity
Any verification, screening, moderation, or review conducted by Anesthesio is limited, discretionary, and for internal risk-management purposes only. Such activities do not create any duty to users and do not constitute a representation, certification, or endorsement regarding employer legitimacy, listing quality, regulatory compliance, hiring intent, compensation accuracy, or facility details.
Employers and recruiters represent and warrant that all listings, compensation disclosures, and related content they provide are accurate, lawful, non-misleading, current to the best of their knowledge, and compliant with all applicable wage-transparency, equal-employment, anti-discrimination, and privacy laws. Employers and recruiters must maintain up-to-date job details and promptly update or remove listings that are no longer active.
We may remove, modify, suppress, or reject listings at our discretion.
4. Indexed Listings
The Services may include job listings indexed and organized from publicly available sources across the web. Similar to how search engines index and present publicly available web content, Anesthesio uses automated systems, including AI, to discover, organize, and present publicly available job posting information to help users find relevant opportunities. These listings are provided for informational and discovery purposes only.
- Source listings may change, expire, or be removed without notice.
- Anesthesio does not warrant the accuracy, completeness, or timeliness of indexed listing data.
- For indexed listings, the original source and the employer are the sole authoritative source of truth. If a conflict exists between an indexed listing and the original source, the original source controls.
- Anesthesio has no obligation to verify, monitor, update, or maintain any third-party or indexed listing and is not responsible for withdrawn, expired, duplicated, inaccurate, fraudulent, or unavailable listings.
5. Informational Purposes Only; No Professional Advice
All information provided through the Services — including job listings, salary data, facility details, AI-generated summaries, and search results — is for general informational and reference purposes only. The Services are designed to help users explore and discover publicly available job opportunities, similar to how real estate platforms display property listings or search engines present web content.
- No guarantee of accuracy. Listing details — including compensation figures, benefits, location, availability, and employer information — are derived from publicly available sources and may be incomplete, outdated, or inaccurate. Users should independently verify all information directly with the employer or original source before making any decisions.
- No employment, medical, legal, or financial advice. Nothing on the Services constitutes professional advice of any kind. We are not an employment agency, staffing firm, recruiter, or career counselor. Any decisions you make based on information found on the Services are made at your own risk.
- Compensation data. Compensation data displayed on the Services may include employer-provided information, publicly available source information, inferred ranges, or AI-generated estimates. Any compensation figure identified as estimated, predicted, AI-generated, or not employer-verified is illustrative only, may differ materially from actual compensation offered, and is not a promise, appraisal, quote, or guarantee of pay. Always verify compensation directly with the employer before making career or relocation decisions.
- AI-generated content. Certain content, including job summaries, descriptions, salary estimates, facility details, and search results, may be generated or enhanced by artificial intelligence. AI outputs may contain errors, inaccuracies, or omissions and should not be relied upon as the sole basis for any employment, hiring, financial, or personal decision.
- AI-powered features. AI-powered features such as search, matching, recommendations, and ranking are intended only to assist with discovery and organization. They are not intended to make or substantially determine employment decisions. Employers, recruiters, and other users remain solely responsible for independently reviewing all outputs and for complying with all applicable employment, anti-discrimination, disability, pay-transparency, and privacy laws.
- Non-reliance. You agree not to rely on the Services as the sole basis for any employment, hiring, compensation, relocation, credentialing, financial, or professional decision. By using the Services, you acknowledge and agree that you bear sole responsibility for evaluating and verifying the accuracy, completeness, and suitability of any information obtained through the Services. Anesthesio is not liable for any loss, damage, or harm resulting from your reliance on any information displayed on or through the Services.
6. Plans, Fees, and Billing
Paid features may include one-time posting fees, bundles, and subscription plans. Current plan names include Provider Pro and Premium Recruiter.
- Payments are processed through Stripe and are subject to Stripe's terms and processing rules.
- Unless otherwise stated at checkout, fees are non-refundable except as required by law.
- Job posting durations are selected at checkout (for example 7, 14, 30, 60, or 90 days where offered).
- Bundle credits cover one standard 30-day posting credit unless explicitly stated otherwise at checkout. Longer durations may require a top-up charge.
- Add-on pricing and availability (including featured/sticky inventory) may change based on availability, demand, and capacity at the time of purchase.
- We may update pricing from time to time and apply changes prospectively where required.
7. Renewals, Subscriptions, and Cancellation
Subscription plans (including Provider Pro and Premium Recruiter) renew automatically on the selected billing cycle unless canceled before the next renewal date.
Individual paid job postings are one-time purchases by default. If you explicitly enable auto-renew for a posting at checkout or in your dashboard, that posting will renew every 30 days until disabled.
- You may cancel subscriptions through account settings or the provided billing portal when available.
- For posting auto-renew, you can disable auto-renew from your dashboard before the next renewal date.
- We may send reminder notices before renewal where configured.
- Failure to pay may result in suspension, plan downgrade, feature loss, or account termination.
8. Acceptable Use
You agree not to:
- Use the Services for unlawful, harmful, deceptive, or discriminatory purposes;
- Upload malware, interfere with system integrity, or attempt unauthorized access;
- Scrape, harvest, copy, or reproduce platform data outside permitted functionality;
- Misrepresent your identity, credentials, employer status, or affiliation; or
- Violate third-party rights, including privacy and intellectual property rights.
9. User Content and Ownership
You retain ownership of content you submit (such as profile information, resumes, and user-posted job descriptions), subject to the rights you grant below.
By submitting content, you grant Anesthesio a non-exclusive, worldwide, royalty-free license to host, process, display, reproduce, and distribute that content as needed to provide and improve the Services.
Publicly available job postings indexed by our systems remain subject to the rights of the original source and are presented for discovery purposes.
10. Intellectual Property
The Services, including software, design, trademarks, logos, and platform content created by Anesthesio, are owned by or licensed to Anesthesio and protected by law.
Except as expressly permitted in writing, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Services.
11. Third-Party Services
The Services may integrate with or rely on third-party services, including Supabase, Stripe, PostHog, Sentry, Resend, and Google. Use of those services may also be subject to third-party terms and policies.
12. Disclaimer of Warranties
THE SERVICES, INCLUDING ALL JOB LISTINGS, SALARY DATA, EMPLOYER INFORMATION, AI-GENERATED CONTENT, AND SEARCH RESULTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANESTHESIO EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, TITLE, AND NON-INFRINGEMENT.
ANESTHESIO DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY INFORMATION, INCLUDING JOB LISTINGS AND COMPENSATION DATA, IS ACCURATE, COMPLETE, CURRENT, OR RELIABLE; (C) ANY JOB LISTING REPRESENTS AN ACTUAL AVAILABLE POSITION; OR (D) THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ANESTHESIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS, WHETHER ARISING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ANESTHESIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, ANESTHESIO WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM: (A) YOUR RELIANCE ON ANY JOB LISTING, SALARY DATA, EMPLOYER INFORMATION, AI-GENERATED CONTENT, OR OTHER INFORMATION DISPLAYED ON THE SERVICES; (B) ANY EMPLOYMENT DECISIONS, HIRING DECISIONS, OR NEGOTIATIONS INFLUENCED BY INFORMATION ON THE SERVICES; (C) ANY INACCURACY, ERROR, OR OMISSION IN INDEXED OR USER-SUBMITTED CONTENT; OR (D) ANY INTERACTION BETWEEN USERS OF THE SERVICES.
TO THE EXTENT LIABILITY CANNOT BE FULLY DISCLAIMED UNDER APPLICABLE LAW, ANESTHESIO'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF: (I) THE AMOUNTS ACTUALLY PAID BY YOU TO ANESTHESIO DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (II) FIFTY DOLLARS ($50.00 USD).
14. Indemnification
You agree to defend, indemnify, and hold harmless Anesthesio, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
Employer and recruiter indemnity. Employers and recruiters additionally agree to defend, indemnify, and hold harmless Anesthesio from any claim arising from their listings, compensation disclosures, hiring practices, candidate communications, screening decisions, or any alleged unlawful, misleading, discriminatory, or noncompliant employment practices.
15. Suspension and Termination
We may suspend or terminate access immediately if you violate these Terms, create legal risk, fail to pay applicable fees, or misuse the platform. You may stop using the Services at any time.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed under the laws of the State of Texas, without regard to conflict-of-law principles.
Mandatory individual arbitration. Except for disputes qualifying for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in Travis County, Texas (or, at your election, by telephone or video conference). The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action and jury waiver. YOU AND ANESTHESIO EACH WAIVE THE RIGHT TO A JURY TRIAL. YOU AND ANESTHESIO EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY CONSOLIDATED OR MULTI-PARTY PROCEEDING. All disputes must be brought in an individual capacity only.
Opt-out. You may opt out of this arbitration provision by sending written notice to [email protected] within 30 days of first accepting these Terms. If you opt out, disputes will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
17. Content Notices and Removal
If Anesthesio receives notice that content on the Services may be inaccurate, unlawful, infringing, or otherwise objectionable, Anesthesio may investigate and, in its sole discretion, remove, revise, suppress, or disable access to such content. Anesthesio's decision not to act, or any delay in acting, does not create liability, establish a duty of care, or constitute an endorsement of the content in question.
18. Force Majeure
Anesthesio will not be liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, internet or infrastructure outages, cyberattacks, labor disputes, or acts of third parties.
19. Severability and Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
20. Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Anesthesio regarding your use of the Services, and supersede all prior agreements, discussions, or understandings on the subject.
21. Changes to These Terms
We may update these Terms periodically. Updated Terms are effective when posted unless a later date is stated. Continued use of the Services after updates means you accept the revised Terms.
